.. 001823

.

feet. Following the enlargement of the Fire Mountain Canal as proposed

for the Paonia project the totel appropriated water will be 385.5 second-

feet. The ultimate demand during the months of June and July will prob-

ably not exceed 350 second-feet.

From the record of runoff at SOmerset during both 1939 and 1940

it appears that there wus sufficient water at that point to supply 350

second-feet in each year until June 25. During the period from 1935 to

1938 inclusive, the decrees could have been supplied at SOmerset until

about July 15 to July 2:>. Actually the date of cell for this water would

be much luter, since the dates given above are those when the river has

dropped to the amount of the decrees and do not take account of either

tributary inflow or of usable return flow below SOmerset. Only in the

dryest yours would prior rights call for water before July 15.

From the actu81 record of tlro years (1939-40) at Horse Ranch

it would therefore ul!l,onr that all water at Horse Rnnch (and at Lake Bren-

nan) l','ould bo storable, except that flowing during the latter half of

,Tuly, 'llld of August end September. Ordinarily 95% of the annual runoff

wouln be storable ffild in dry years probably not lass than 90',&. Prior

rights cannot, therefore, interfere ~~th storage in the ameunt necessary

for the torm of Crested Butte, most of ',vhieh would actuelly accumulate

early in May.

Liti~ation Involving Lake Brennan

As stated the tewn of Crested Butte built the present 10-foot

timber crib at the Anthracite Creak outlet from Lake Brennon about 1918,

and by means of this structure stored about 385 acre-feet of water. It

was planned to raise the structure another 10 feet, thus increasing the

stored Imter to about 1,000 acre-feet, but this was not done. No attempt

.

.

-16-
