ISSUE <br /> <br />The special federal status of Indian lands and <br />corresponding trust responsibilities of the United States <br />Government. <br /> <br />RECOMMENDATION <br /> <br />It is recommended that the Bureau of Indian Affairs, in <br />consultation with the affected tribes, review all studies and <br />recommendations, carried out pursuant to the Colorado River <br />Floodway Protection Act and the Task Force's report, to <br />ensure that the trust responsibilities of the United States <br />are met. <br /> <br />V. ISSUE <br /> <br />Section II of the Colorado River Floodway Protection Act <br />requires the Secretary of the Interior to analyze the effects <br />of the Act on the economic development of the Indian tribes <br />whose lands are located within the Floodway. <br /> <br />DISCUSSION <br /> <br />The Secretary's report concerning the effects of the <br />Floodway on the economic development of the Indian lands <br />located within the Floodway was mandated in view of the trust <br />relationship which exists between the United States and the <br />five Indian tribes, and the potentially limiting effect the <br />Floodway may have on the economic development of the Indian <br />tribes. It is recognized that fulfillment of many of the <br />Task Force's recommendations pertaining to Indian lands could <br />affect the economic development of the Indian tribes and that <br />specific Congressional appropriations will be required for <br />implementation of the Floodway with respect to Indian lands <br />in accordance with the trust responsibility of the United <br />States and the policy of self determination. <br /> <br />RECOMMENDATION <br /> <br />It is recommended that the Secretary, in carrying out <br />his/her responsibilities pursuant to Section 11 of the Act, <br />direct that the studies of the effects of the Act on economic <br />development of the five Indian tribes be conducted separately <br />to specifically assess the effects relative to each tribe. <br />It is recommended further that the Congress should provide <br />sufficient appropr iations, in accordance with Section l5 of <br />the Colorado River Floodway Protection Act, to ensure that <br />the implementation of the Act is consistent with the trust <br />responsibility of the United States to the tribes. <br /> <br />VIII-6 <br />
