<br />. <br /> <br />. <br /> <br />. <br /> <br />002255 <br /> <br />all reasonably foreseeable, direct, and consequential damages <br />to the property of the tribe, private persons, and the united <br />States, which may result from the proposed lease. <br /> <br />Senate Report 99-4l0, in discussing Section 7 of the <br />Act, stated that the Secretary has the authority to review <br />tributary inflow systems and river bank stabilization <br />programs for reservation lands and to determine whether <br />additional work is necessary. Section l5 of the Act, dealing <br />with authorization of appropriations, states that Indian <br />tribes may be eligible under Public Law 93-638, the Indian <br />Self Determination and Education Assistance Act, to contract <br />for studies of Indian lands required under the provisions of <br />the Floodway Act. <br /> <br />The issues addressed by the Task Force relative to the <br />potential application of the Floodway on Indian lands and <br />recommended legislation or regulations needed to achieve the <br />purposes of the Floodway deal with the need to provide <br />necessary funding, in accordance with Section 15 of the ~ct, <br />to ensure that the remedial measures recommended by the Task <br />Force are carried out: to establish flood plain management <br />regulations: to provide for flood plain and flood hazard <br />mappingt to provide for flood plain management planning and <br />coordination in development and land use plans for <br />reservation lands: to study and assess needed river bank <br />stabilization, tributary flood and erosion control, and <br />Floodway improvement works: to identify high ground water- <br />prone areas under Floodway elevation flow conditions and <br />potential mitigation measures: to assess any economic <br />development impacts of the Act on the Indian tribes whose <br />lands are located within the Floodway: and to establish a <br />liaison at the local level between the Bureau of Reclamation <br />and the Bureau of Indian Affairs to ensure that the <br />implementation of the Act on Indian lands is consistent with <br />the trust responsibility of the United States to the five <br />Indian tribes whose lands are located within the Floodway. <br /> <br />This chapter applies specifically to Indian lands. <br />Other chapters also make reference and apply to Indian lands <br />and tribal entities. Where there is a conflict between other <br />provisions within this report and Chapter VIII, the <br />provisions of Chapter VIII shall govern. <br /> <br />I.
