<br />002251 <br /> <br />. <br /> <br />is recommended that the Federal Emergency Management Agency <br />be designated the federal agency to process such claims and <br />. that federal funds be appropriated for this purpose as well <br />as for compensation awards. Claimants should be held <br />responsible for producing all evidence validating their <br />eligibility and requests for compensation. <br /> <br />. <br /> <br />Given the time lapse since the hardships occurred, the <br />processing of claims should be carried out in the most <br />expeditious manner. Consideration should also be given to <br />cost indexing of monetary losses with respect to compensation <br />awards to account for price increases since 1983. Claimants <br />should be provided six months to file claims, with provisions <br />for one 6-month extension upon written request, from the date <br />that this recommendation is accepted and approved by the <br />Secretary of the Interior and the House Committee on Interior <br />and Insular Affairs, the Senate Committee on Environment and <br />Public Works, and the Senate Committee on Energy and Natural <br />Resources and authorizing legislation is enacted. Twelve <br />months from the date of filing of each claim should be set <br />as the final date by which a claim be processed and <br />compensation awarded. The Federal Emergency Management <br />Agency should be directed to provide sufficient public <br />notice for filing of claim applications. Such notice, <br />together with the name and address of the program <br />administrator, should be provided to all entities represented <br />on the Task Force. <br /> <br />The Bureau of Reclamation and appropriate state disaster <br />assistance agencies should be directed to assist the Federal <br />Emergency Management Agency in verifying claims relative to <br />eligible impacted areas and the extent and duration of <br />impacts. It is recommended further that a summary report on <br />all compensation awards be submitted to the Secretary of the <br />Interior and the Congress by the Federal Emergency Management <br />Agency within three months from the final date for <br />compensation awards. <br /> <br />The following are the recommended minimum criteria for <br />determining eligibility for compensation. Claims must meet <br />the criteria for both "economic hardship" and impacts "not <br />reasonably foreseen." <br /> <br />A. "Economic Hardship" Criteria <br /> <br />. <br /> <br />l. Real and Personal property Losses In Excess of $5,000 <br /> <br />a. property losses are eligible to the extent they <br />relate solely to the 1983 high river flows and <br />not previously compensated by <br /> <br />VII-4 <br />
