<br />ori2l85 <br /> <br /> <br />The Task Force also recommends that compensation should <br />be recommended in specific cases of extraordinary hardship <br />resulting from impacts of the 1983 high Colotado River flows <br />on property outside of the Floodway which could not <br />reasonably have been foreseen. Specific recommended minimum <br />criteria relative to "economic hardship" and impacts "not <br />reasonably foreseen" are provided by the Task Force to <br />'determine the eligibility for financial assistance. In <br />~making these recommendations, the Task Force fully recognizes <br />'federal budgetary constraints. However, it is anticipated <br />:that claims meeting the recommended criteria would be limited <br />=and that the total claims would not materially affect the <br />'federal budget. <br /> <br />The Task Force in making its recommendations concerning <br />the Floodway took into consideration the special federal <br />status of Indian lands held in trust by the united States. <br />In this regard, specific recommendations were made relative <br />to the potential application of the Floodway on Indian lands, <br />as well as recommended additional legislation and regulations <br />that would help achieve the purposes of the Floodway. <br />'Coupled with this, the Secretary of the Interior in making <br />~his report to the Congress on the Floodway and on the report <br />:of the Task Force is, pursuant to Section 11 of the Act, to <br />'~analyze the effects of the Act on the economic development of <br />~-the Indian tribes whose lands are located within the <br />,~~j : Floodbway. <br /> <br />In accordance with the Act, as soon as practicable after <br />the determination of the Floodway boundaries, the Secretary <br />is to prepare and file wi th the Congress maps depicting the <br />Colorado River Floodway. In ,accordance with Section 5 of the <br />Act, the Floodway maps shall be considered a standard map to <br />be adhered to by all agencies, shall have the same force and <br />effect as if included in the Act, and shall be distributed to <br />appropriate identified entities. The Secretary is to submit <br />written certification to the Congress on or before January 5 <br />of each fiscal year that all concerned federal agencies have <br />complied with the provisions of the Act. <br /> <br />The Secretary is also to conduct, at least once every <br />five years, a review of the Colorado River Floodway and make, <br />after appropriate notice and consultations, such minor and <br />technical modification to the boundaries of the Floodway as <br />are necessary solely to reflect changes that have occurred in <br />the size or location of the flood plain as a result of <br />natural forces and as are necessary, pursuant to Section 7 of <br />the I'.ct, for the maintenance, replacement, reconstruction, <br />repair, and expansion of publicly or tribally owned or <br />operated roads, structures (including bridges), or facilities. <br /> <br />I'. summary of the recommendations of the Task Force is <br />provided in the following table. <br /> <br />iii <br />
