'"1'12") '.
UU ",i~

.

II. ISSUE

Incorporation of the Colorado River Floodway and its
provisions into local flood plain management regulations.

DISCUSS ION

.

To restore and maintain an effective Colorado River
Floodway requires that the Floodway and its provisions be
incorporated into local flood plain management regulations.
No specific changes in National Flood Insurance Program rates
nor participation in the Program can occur until such
regulations have been amended to reflect the Floodway and its
provisions. Model regulation amendment language would
provide for the efficient, timely, consistent, and
coordinated incorporation of the Colorado River Floodway into
existing flood plain management regulations as well as for
establishment of regulations for areas along the river.

There presently exists for the three states in which the
Colorado River Floodway resides, model flood plain management
ordinances which meet the minimum requirements of the
respective State statutes and the National Flood Insurance
Act of 1968, as amended. These, together with handbooks and
other guidance material, are intended to assist local
enti ties in the development of their flood plain management
ordinances.

In the case of the State of Nevada, the model ordinance
applicable to the Colorado River is entitled "Uniform
Regulations for the Control of Drainage, Clark County
Regional Flood Control District." For Arizona, the Arizona
Department of Water Resources has a model regulation referred
to as "Model Ordinance for Flood Damage Prevention."
Likewise, in California, the California Department of Water
Resources has developed a model ordinance, the most recent
edition of which is referred to as "Model Floodplain
Management Ordinance for California Communities, April 1987."

RECOMMENDATION

.

To help provide for the expeditious and uniform
implementation of revisions to local flood plain management
regulations that will provide for the restoration and
maintenance of the Colorado River Floodway, it is recommended
that the following provisions be used as the basis for
amendments to local regulations. These provisions should be
incorporated into the model regulations for flood plain
management for the three States in which the Colorado River
Floodway is located. The recommended provisions apply to

1II-4
