Permit Tribal monetary recovery from United <br />States if water is not delivered by the United States to the <br />Tribes in a timely fashion. <br /> <br />e. Ensure completion of Federal obligations <br />contemplated by the Agreement in a timely fashion. <br /> <br />f. Permit the Mancos Valley Irrigation District to <br />defer Federal repayments while contributing to the up-front <br />financing of the Animas-La Plata project. <br /> <br />g. Provide Federal money for the Tribal development <br /> <br />funds. <br /> <br />2. Judicial Approval <br /> <br />a. A consent decree incorporating the Agreement will <br />be presented to Colorado District Court for Water Division No. <br />7 by October l. 1986. <br /> <br />b. The decree will become final upon joint <br />certification by the signatories to the Agreement that the <br />legislation required to implement the Agreement has been <br />obtained. <br /> <br />c. If the court deviates from the Agreement in any <br />material way. the Agreement may be voided by either the Tribes <br />or the Colorado Attorney General. <br /> <br />3. Remedies In The Event Continqencies Are Not Met <br /> <br />a. The parties agree to ask Congress to appropriate <br />$49.5 million for the Tribal development funds. If Congress <br />fails to do so. the Tribes may void this agreement upon 30 days <br />notice to the Colorado Attorney General. <br /> <br />b. Colorado agrees to seek $6 million for the <br />development funds to construct the Towaoc domestic water <br />pipeline and distribution system. [Note: this money has <br />already been appropriated and its expenditure authorized by the <br />Colorado General Assembly. <br /> <br />c. The parties agree to ask the Congress to waive <br />immunity from Tribal lawsuits for damages if the United States <br />fails to deliver water in a timely fashion to the Tribes from <br />the Dolores and Animas-La Plata Projects. <br /> <br />4. Ratification and MOdification of Aqreement <br /> <br />a. All ratifications required of signatories shall be <br />obtained by April 30. 1986. <br /> <br />b. The Agreement may not be modified except by joint <br />consent of the parties. <br /> <br />-7- <br />
