State <br />of Colorado. the applicants consult with and obtain the <br />approval of the Department of Natural Resources on any pre- <br />liminary per~it investigations and procedures that vary <br />from those contained in the detailed work plan submitted in <br />this matter. <br /> <br />kQ.tiU~lO!'t <br /> <br />The F.E.R.C. must prepare an environmental assessment <br />of the proposed preliminary permit studies. Only by the pre- <br />paration of suCh an assessment will the F.E.R.C. be able to <br />properly fulfill its statutory obligations. Only upon the <br />completion of the environmental assessment and any other <br />necessary environmental investigations. will the F.E.R.C. <br />be able to properly condition any preliminary per~it issued <br />in this matter. <br /> <br />The imposition of the conditions proposed herein by <br />the Department of Natural Resources are considered to be <br />the minimum number necessary to prevent the preliminary <br />permit investigations from adversely affecting the wildl ife <br />of the State of Colorado. These conditions are intended to <br />be cumulative and not in 1 ieu of any other conditions imposed <br />by law upon the applicant. The nature of these conditions <br />will not impose an unreasonable burden upon applicants' abil- <br />ity to perform its preliminary investigation. This is the <br />case because the majority of the restrictions only apply <br />when the weather conditions are generally too severe to <br />permit applicant to carry out any of the restricted investi- <br />gative activities. Those conditions which extend beyond <br />the winter period apply only to a small fraction of the <br />total project area and are of vital importance to the protec- <br />tion of valuable wildlife species. <br /> <br />-5- <br /> <br />0966 <br />
