COLORADO and VIDLER WATER TUNNEL COMPANY PROJECT NO. 2763 PETITION OF THE DEPARTMENT OF NATURAL RESOURCES. STATE OF COLORADO FOR THE IMPOSITION OF CERTAIN CONDITIONS ON ANY PRELIMINARY WORK PERMIT ISSUED TO APPLICANTS This petition is in response to the "F.E.R.C. Prelimi- nary Permit Application Detailed Work Plan" submitted by the City of Golden. Colorado and Vidler Tunnel Water Company. appl icants in project No. 2763. The purpose of this petition is two-fold. First. it is to re-assert the position of the Department of Natural Resources that the F.E.R.C. should pre- pare an assessment of the environmental impacts of the pro- posed preliminary permit period stuoies. The second purpose of this petition is to request certain minimum conditions be ~laced upon any preliminary permit issued in this matter. Bf~Ul~~~YlRQtl~ftll!1-A~~f~~~ The "F.E.R.C. Preliminary Permit Detailed ~ork Plan" show that appl icants will carry out extensive geological. geophysical. biological. hydrological and other investiga- tions during the prel iminary permit study period. These studies. when compared with the data s~bmitted by the Depart- ment of Natural Resources. show there is considerable poten- tial far adverse environmental impacts during the study period. 8ased on these submiSSions it can not be categori- cally determined that iSsuance of a prel iminary permit will not have significant impacts on the human environment. Thus. far the reasons stated in part II C of the "Petition of the National Wildlife Federation. et al. ..." the F.E.R.C. must prepare an environmental assessment of the proposed pre-, liminary per~it studies. This environmental assessment must be prepared prior to the issuance of any prel iminary per.nit. 0970 17<J1
