STATE OF COLORADO FOR THE IMPOSITION <br />OF CERTAIN CONDITIONS ON ANY PRELIMINARY WORK <br />PERMIT ISSUED TO APPLICANTS <br /> <br />This petition is in response to the "F.E.R.C. Prelimi- <br />nary Permit Application Detailed Work Plan" submitted by <br />the City of Golden. Colorado and Vidler Tunnel Water Company. <br />appl icants in project No. 2763. The purpose of this petition <br />is two-fold. First. it is to re-assert the position of the <br />Department of Natural Resources that the F.E.R.C. should pre- <br />pare an assessment of the environmental impacts of the pro- <br />posed preliminary permit period stuoies. The second purpose <br />of this petition is to request certain minimum conditions <br />be ~laced upon any preliminary permit issued in this matter. <br /> <br />Bf~Ul~~~YlRQtl~ftll!1-A~~f~~~ <br /> <br />The "F.E.R.C. Preliminary Permit Detailed ~ork Plan" <br />show that appl icants will carry out extensive geological. <br />geophysical. biological. hydrological and other investiga- <br />tions during the prel iminary permit study period. These <br />studies. when compared with the data s~bmitted by the Depart- <br />ment of Natural Resources. show there is considerable poten- <br />tial far adverse environmental impacts during the study <br />period. 8ased on these submiSSions it can not be categori- <br />cally determined that iSsuance of a prel iminary permit will <br />not have significant impacts on the human environment. <br />Thus. far the reasons stated in part II C of the "Petition <br />of the National Wildlife Federation. et al. ..." the F.E.R.C. <br />must prepare an environmental assessment of the proposed pre-, <br />liminary per~it studies.
