<br />. ~ -. . <br /> <br />a study conducted by one federal agency showed three times the flood <br />discharge of a study conducted in the same area by another federal <br />agency. The almost unanswerable question posed to local authorities <br />in such cases is that relating to which study they should believe. <br /> <br />A further conflict in this matter is that in 1966 the General <br />Assemb~y enacted laws authorizing cities and counties to designate <br />floodplains for zoning purposes. However, those laws provided that <br />such designation could occur only after such floodplains have been <br />approved by the Colorado Water Conservation Board. The 1974 amendments <br />to the Land Use Act apparently overlooked the already existing provisions <br />relating to floodplain designation, and these amendments (H.B. 1041) <br />therefore appear' to be inconsistent with the earlier laws relating to <br />floodplain designation (30-28-111 and 31-23-201). Subsection (b) of <br />the proposed amencment would bring all these laws into conformity. <br /> <br />The proposed amendments are as follows: <br /> <br />Amend 24-65.1-403 to add a new subsection (3), to read as follows: <br /> <br />"(3)(a) The Colorado water conservation board shall coordinate <br />any required financial assistance and shall further coordinate and pre- <br />scribe the standards for all floodplain studies conducted pursuant to <br />this article, including those conducted by federal, local or other <br />state agencies, to the end that reasonably uniform standards can be <br />applied to the identification and designation of all floodplains within <br />the state, and to minimize costly duplication of effort. <br /> <br />(b) No floodplains shall be designated by any local govern- <br />ment until such designation shall have been first approved by the <br />Colorado water conservation board as already provided in sections 30- <br />28-111 and 31-23-201." <br /> <br />2470 <br /> <br />FLS : nun <br /> <br />Memorandum <br /> <br />-2- <br /> <br />January 5, 1977 <br />
