"That whenever in carrying out the provision of the
Reclan~tion Law, storage of carrying capacitty has
been or tlay be provided in excess of the requiranents
of the lands to be irrigated under any project, the
Secretary of the Interior, preservin: :l first rl/;ht
to lands and entryrlen under the project, is hereby
authorized upon such ter~s as he may detercdne carriage
of water to an extent not exceeding such excess capacity
with irrigation'syste~s operating under the act of
August 18, 1894, known as the Cary Act, the individuals,
corporations, associations and irrigation districts
organized for and engaged in furnishing or in distri-
buting water for irrie-,tion purposes", and

WHEREAS:
Contracts, placed
as follows:

The BUreau of Realanation in preparing its Warren Act
in each such contre,ct a paragraph in words and fieures

"It is further understood that the water users under
the project of the United States Reclam~tion Service
dependent for storage upon the said storage works
shall be prior to the Company and to water users under
its canal in right to the use of stored waters fron'
the said storage works in accordance with ~rtic1e I,
of the Warren Act", and

WHEREAS: The Bureau of Reclanr.tion in the distribution of the
storage water to Warren Act Contractors has not distributed these stored
waters of the Njrth Platte Project in accordance with the ~~rren ~ct
and said Warren Act Contract, and has not presJrved a first right to the
use of the waters stored in'the Pathfinder Reservoir for the water users
of the North Platte Project, but has pro-rated the waters of said reservoi~
during years of insufficient water supply, to Warren :,ct Contr",ctors :.,S
well as to the water users under the North Platte Project, and

Yn1ERE,S: Said pro-rating of the stored waters of said project
to the Warren .<ct Contractors has been in violation of both the law and
the contracts and has given to the "iarren ,:'ct Contr',ctors waters to which
they are not entitled under either the law or the contract and has reduced
the available waters for the water users under the Pathfinder Irrigation
District and has resulted in serious losses to the water users .)f the
Pathfinder Irrigation District in years of shortage of water, and

WHEREAS: The continued use jf the progran of distribution now
followed by the Bureau of Reclamation in the delivery of the stored waters
of the North Platte Project will further dnnage the water users of the

Now, Therefore, Be It Resolved: That the water users of the
Pathfinder Irrigation District hereby urge the Board of Directors to take
such legal ~tion ~s wi~ bring about a proper distribution of the stored
waters of the North Platte Project and that if necessary legal action be
taken to prevent further delivery of stcred waters t? Warren ~ct ContrQctors
in time of sh)rtage provided that a najority of the N'rth Platte Project
