AN ORDINANCE OF THE BOARD OF SELECTMEN FOR THE TOWN OF
GEORGETOWN, COLORADO FORMALLY ESTABLISIllNG A WATER AND SEWER
ACTIVITY ENTERPRISE COMPRISED OF THE TOWN'S WATER AND SEWER
FACILITIES AND SERVICES.

WHEREAS, the Town has historically operated and otherwise treated the municipal water
and sewer system as a separate and quasi-independent department of the Town government; and

WHEREAS, in 1993 the State Legislature adopted Article 45.1 ofTitle 37 of the Colorado
Revised Statutes so as to allow for and promote the formal establishment of water activity
enterprises at the state and local level; and

WHEREAS, the Board of Selectmen desires to formally establish a water and sewer
enterprise so as to confirm and continue the operation of the Town's water and sewer services as an
enterprise as defined under state law.

NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF SELECTMEN FOR
GEORGETOWN, COLORADO as follows:

Section One

That Title 13, "Public Services," of the Georgetown Municipal Code be amended by the
addition of new Chapter 13.40, "Water and Sewer Activity Enterprise," such new chapter to state
as follows:

and/or reestablished, the Georgetown Water and Sewer Activity Enterprise pursuant
to Article 45.1, Title 37 of the Colorado Revised Statutes (the "W&S Enterprise"),
