PREISSER PURCHASE OF AUGMENTATION WATER <br /> <br />preisser seeks approval of a loan from the Colorado Water <br />Conservation Board in the amount of $90,000.00 from the Horse Creek <br />Basin Account authorized by S.B. 97-008. The loan of $90,000.00 to <br />Preisser was considered and approved in concept at the January, <br />1997 CWCB meeting. <br /> <br />preisser owns six wells located in Sections 22 and 29, Township 14 <br />South, Range 58 West, Lincoln County, Colorado. Disputes over <br />water use have occurred between preisser and the other water users <br />in the Horse Creek Basin area. ~he other parties involved are: <br />Reid Cattle Co., Smith Cattle, Inc., Horse Creek Water Users <br />Association ("HCWUA"), and Box Spri.ngs Canal and Reservoir Company. <br />These parties and the State and Division Engineers were named <br />defendants in preisser's suit in Water Court, Water Division No.2, <br />Case No. 97CW010, which seeks a d~claratory judgment that pumping <br />of his wells may not be curtailed under the new Arkansas River <br />rules. The parties have recently reached a settlement in principle <br />of the issues in the case. The parties have agreed to put the case <br />on hold for 90 days to allow time to finalize settlement <br />agreements. <br /> <br />The settlement between preisser and the other parties is the last <br />piece of the overall settlement of Horse Creek Basin issues. The <br />loan amount of $90,000.00 is the remaining balance in the Horse <br />Creek Basin Account. <br /> <br />In broad terms, the settlement is structured as follows: <br /> <br />. All parties consent to pumping and consumptive use by the six <br />Preisser wells of 600 acre-f~et per year. <br /> <br />. Preisser makes monetary payments in the following amounts: to <br />Smith, $5,000.00; to Reid, $115,000.00; to Box Springs, <br />$100,000.00. <br /> <br />. preisser agrees to comply with the Arkansas Rules, to augment <br />the 600 acre-feet, and to abandon his water rights in excess <br />of that amount. <br /> <br />. preisser will purchase 3.0 ~fs augmentation water from Box <br />Springs. <br /> <br />Specifics of the settlement agreements: <br /> <br />. <br /> <br />Preisser will sell land and water rights to Bell Farms, a hog- <br />raising operation.
