As you know, the Overland <br />Ditch & Reservoir Company has been in a fight with the United <br />States ,..Forest Service for the last two years over a by-pass flow <br />release, they demanded as a condition for a permit to rehabilitate <br />,our dam.,.This release is not for ~ndangered species.. but, in the <br />Forest Sg,rvice' s own words, "to enhance a fishery". 'Our: company <br />President, Peter Kasper, ,met with you in Palisade on March 16th <br />of this year to discuss. this problem.' At that time:;' you:.showed <br />great concern and promised that the Sta.tewould he1p,"but also <br />strongly suggested that the Overland "back off" in making an <br />issue""pye,r this problem until the State solved the similar <br />problem some front range cities W~re having. Mr~ Kasper stated <br />that our situation was aifferent from the front range cities in <br />that we were already releasing th~ by-pass flow; and continuation, <br />especially in a dry year, could b~ financially devastating. We <br />were assured to hold off, help from the State was on the way. <br /> <br />Since March, we have had countless conversations and meetings <br />with Doug Robotham of the Departm~nt of Natural Resources, Peter <br />Evans of C_W.C.B_ and Wendy Weis of the Attorney General's Office. <br />In all instances, especially with Doug Robotham, we have been <br />assured that the State will help Qs. However, we are at a point <br />where the irrigations season is OVer and the damage has been done. <br />You know how dry Western Colorado was, this summer. When you visited <br />the site of the Wake Fire, you were in the area served by the <br />Overland Ditch & Reservoir Company. You witnessed the dryness. We <br />need every drop of water available for irrigation, not to send <br />down a creek so there would be a better fishing hole. <br /> <br />We have worked with the Soil Conservation Service, Division <br />of Water Resources, and our own shareholders to get an accurate <br />accounting of the actual financial losses caused by the by-pass <br /> <br />ATTACHMENT 1 <br /> <br />" <br />iI <br />_/ <br />
