On January 29,1997, Federal District Court Judge Edward Nottingham signed <br /> <br />ajoint motion to dismiss the Overland's case against the Forest Service based upon certain <br /> <br />stipulations including the recognition of a 1891 Act right-of-way easement for the entire reservoir <br /> <br />and ditch system crossing federal lands (a total of'2Z7 acres), and the enforcement of an easement <br /> <br />pursuant to the Federal Land Policy and Management Act (FLPMA) for the remaining 3.1 acres of <br /> <br />the system. Pursuant to the express terms of the FLPMA easemant, the Company has also stopped <br /> <br />releasing a bypass flow out of its reservoir down Cow Creek, and instead is paying a rental fee for <br /> <br />1 <br /> <br />. <br />
