Ule, Director <br />1313 Sherman Street <br />Denver, CO 80203 <br /> <br />Dear Mr. Ule and Board Members: <br /> <br />The Overland Ditch and Reservoir Company is pleased to announce the <br />successful cOnclusion of its lawsuit against the U.S. Forest Service. I have enclosed a <br />copy of a press release, a copy of 'an article from Colorado Rancher and Farmer, and <br />a copy of the judge's decision. Although the case was .settled", the decision issued by <br />the judge concerning the scope of 1891 rights is important to all water users with <br />facilities of Federal lands. The Company knows that its efforts have and will help other <br />water users. If you have any questions after reading the press release or decision, <br />please to not hesitate to contact either Karen Budd-Faren or me. <br />The OVerland Ditch and Reservoir Company shareholders celebrated their <br />victory at their annual meeting in February. They also had to deal with how to pay for <br />the expenses associated with the suit' At the meeting the shareholders decided to <br />assess themselves the full $31,000 that the CWCB deferred .forthem last fall. This <br />money will be 'used to pay a portion of the leg&l expenses; . HoWever, the total cost of <br />the suit is over $115,000. The Colorado Rlver Water Conservation,Board has.donated <br />$20,000 towards the suit with a promise of at least another $5,000. We have also <br />received another $3,000 from other entities. At this point the burden of the remaining <br />costs falls on the Overland shareholders. We greatly appreciate the loan deferments <br />you have granted, but also feel We have an obligation to make our loan 'payments. <br />The Overland is seeking assistance to pay our legal bills. Since the Colorado <br />River Water Conservation Board recognizes the importance of our suit to the extent <br />that they have already contributed $20,000, we feel that the CWCB should at least <br />match the River District's contribution. This would greatly help the Overland <br />shareholders and make it easier for them to meet their other obligations. Please let us <br />know if you can contribute. <br />Thank you. <br /> <br />c.c.
