3, Type of organization: A ditch and resen'oir company will be formed and the
loan applicants will own shares of stock in said company in direct proportion to the
amount of firm annual yield in Eagle Park Reservoir they acquire.

4. Is the organization incorporated in the State of Colorado?

(a) Eagle County is a Colorado County,

(b) The Upper Eagle Regional \Vater Authority is a water authority organized
under C.R.S. ~ 29-1-204.2 and consists oflhe Arrowhead. Avon. Beaver
Creek. Rcrry Creck. Eagle-Vail and Edwards Metropolitan Districts. which
are all Colorado special districts.

(c) The Vail Valley Consolidated Water District is a special district organized
under Colorado law.

(d) The Vail Corporation dba Vail Associates. Inc. is a Colorado corporation.

Copies of the agreement creating the Authority. the Court Order creating the
Consolidated District. and the articles of incorporation of The Vail Corporation
are attached hereto as Exhibits A. Band C. respectively.

5. Please provide a brief description of the owner's existing w~,tcr supply
facilities and described any existing operational or maintenance problems.
For a description of the water supply facilities of the Authority and the
Consolidated District. see the report with enclosed descriptive maps attached
hereto as Exhibit D.

6, For existing facilities indicate the number of customers sen'ed:

(a) The Upper Eagle Regional Water Authority serves 8321 SFE's which
amounts to approximately 29.000 indi\'idual customers,

(b) The Vail Valley Consolidated Water District serves 3-158 Sr-E's which
amounts to approximately 29.500 individual customers.
