(. , I 53 (., 7'i? ; and <br /> <br />, <br />WHEREAS, required approval, clearance and coordination have been accomplished from and with appropriate agencies; and <br /> <br />WHEREAS, pursuant to the provisions of sections 37-60-119 and 37-60-l22(l)(c), <br />Colorado Revised Statutes, as amended, the State is authorized to loan money for the <br />construction or implementation of certain water projects for the benefit of the people of the <br />State of Colorado, and to expend monies for feasibility investigations; and <br /> <br />WHEREAS, The Borrower has made application to the State for a 10llI1 to conduct a <br />Feasibility Study to evaluate alternatives for a' substitute supply plan that would allow the <br />Borrower's members to continue to use their wells which draw water from aquifers tributary <br />to the Arkansas river; such substitute supply plan hereinafter sometimes referred to as The <br />Project; and <br /> <br />WHEREAS, the Borrower is a duly constituted non-profit corporation formed under <br />section 31-24-1 et.seq. Colorado Revised Statues (1967 supp.), in the State of Colorado; and <br /> <br />WHEREAS, the Colorado Water Conservation Board approved at their JlII1uary 19, 1994 <br />meeting, a loan to the Borrower in a maximum amount of Sixty-Five Thousand Dollars <br />($65,000) to conduct said Feasibility Study; and <br /> <br />Page 1 of 12 Pages <br />
