The City <br />represents that except to the extent that such funds will come <br />from the new debt financed pursuant to Paragraph 3.e., below, it <br />obligates itself to appropriate the funds necessary to meet this <br />commitment. To the extent that the Public Works Department here- <br />after determines that additional work is required and if the City <br />Council approves the additional work in the course of a subsequent <br />year's budget, additional improvements may be made. Following the <br />initial commitment of spending $300,000, road, stree~, and drain- <br />age structure improvements in the District will be on an equal ba- <br />sis with other areas of the City. Work prioritization will be de- <br />termined by the city Council. In addition, on and after the <br />annexation date, all street, road and drainage structure mainte- <br />nance and repairs in the District will be performed by the City, <br />on an equal basis with other areas of the City. The cost of such <br />maintenance and repairs shall not be included in the $300,000 ini- <br />tial commitment for capital improvements, but shall be in addition <br />to such commitment. For the purposes of this paragraph, capital <br />means the installation or replacement of infrastructure as opposed <br />to the on-going regular repair ~nd care of the infrastructure. <br /> <br />4. Police: On and after the annexation date, <br />police services provided by the City in the District -will be the <br />same as is provided in other ar~as of the City. The City does not <br />assign particular officers to p~rticular areas or neighborhoods, <br />nor does the City operate particular routes for patrol. There- <br />fore, it is not possible to def~ne precisely the services that <br />will be available. However, t~e City does agree that police ser- <br />vices will be applied on an equitable basis in the District; de- <br />pending on needs and circumstances. <br /> <br />5. Communitv D~ve1opment Department and Zoninq: <br /> <br />a. On and after the annexation date, the <br />residents of the District will bave available to them the various <br />services provided by the City'S Community Development Department. <br />The District lands will be incorporated into the ongoing planning <br />efforts of the City. The District lands will be subject to the <br />land use subdivision and zoning controls and benefits of the City. <br />The zoning which will be applied to the District lands on the an- <br />nexation date will be substantially identical to that currently in <br />existence, subject to the final adoption by the City Council of a <br />zoning ordinance. The existing District office and lands upon <br />which it is constructed will be rezoned to a business or commer- <br />cial use, provided that any such rezoning will be compatible with <br />the residential character of the surrounding neighborhood as de- <br />termined by the City Council. The City Council reserves the right <br />to modify zoning of any lot or parcel within the District in <br />accordance with state and local law.
