<br />IMPLEMENTATION SCHEDULE <br /> <br />The construction activities at Kern Reservoir are proposed to begin with the drawn down of the water <br />surface in mid-September 2002. Dewatering and excavation activities will follow as soon as possible. <br />The goal for the 2002-2003 irrigation off-season is to: I) excavate and haul material for use on the <br />neighboring development, 2) construct the slope liner, and 3) remove approximately 400,000 cubic <br />yards of sand and gravel to the nearby mine for processing. Additional excavation and haul of aggregate <br />materials is scheduled to occur during the 2003-2004 and 2004-2005 off-seasons. <br /> <br />SOCIAL. ECONOMIC. AND PHYSICAL IMPACTS <br /> <br />The project will provide full storage capability for the reservoir. The reservoir has filled with silt due to <br />the inlet of the New Cache la Poudre Ditch. The inlet of the ditch is being relocated as a part ofa <br />separate project done by the Town of Windsor and Lot Holding Investments to further eliminate the <br />silting problem. As a result, the reservoir will have many positive social impacts, as it will allow for <br />additional storage capacity; a healthier ecology for fish, birds, and other wildlife; increased recreational <br />uses for the citizens ofthe Town of Windsor; some storm water uses; and other irrigation purposes. <br /> <br />The project will have a positive economic impact of providing the historical storage capacity for <br />irrigation water to the shareholders' agricultural lands, as well as other irrigation uses. Due to the silting <br />problem, the historical storage has not been possible in the past. <br /> <br />The project will have no significant impact once construction is complete. <br /> <br />PERMITTING <br /> <br />The Kern Reservoir and Ditch Company must obtain authorization from the Colorado State Engineer's <br />Office for the proposed modifications, only if the reclamation is within 200 feet ofthe current dam <br />structure. At this time, the plan is not to reclaim any portion of the reservoir within the 200-foot buffer <br />area of the dam. The local office of the U.S. Corps of Engineers has been consulted, and it has been <br />determined by Terry McKee, that this reservoir is not under the jurisdiction of the Corps. Larry <br />Rogstadt, with the Colorado Division of Wildlife has been consulting several times in regard to any <br />wildlife habitat on the reservoir and careful consideration will be taken during the reclamation process. <br />A letter has been sent to the Colorado Division of Minerals and Geology (DMG) to determine if a <br />permit is required. It is our understanding that a Declaratory Order is the appropriate permitting process <br />with the DMG. Other permits regulating the particulars of construction activities (i.e., construction <br />dewatering, roadway access, dust, etc.) will be the responsibility ofthe selected contractor to obtain. <br /> <br />INSTITUTIONAL CONSIDERATIONS <br /> <br />An agreement with the New Cache la Poudre Ditch Company is in the process and the only other <br />contracts, agreements, or Court actions necessary for the construction of the project, are a loan contract <br />with the CWCB, a construction contract with the construction company, and an engineering contract <br />with Rocky Mountain Consultants, Inc. <br /> <br />Feasibility Study <br />Kern Reservoir Enlargement <br /> <br />.4- <br /> <br />August 2002 <br />1:\0636_142\Windsor Lake FS,do<; <br />
