Hallford, Esq, <br />Colorado River Water Conservation District <br />P,O, Box 1120 <br />Glenwood Springs, CO 81602 <br /> <br />1""_,,,,_,,, <br />r..;,_",-", ~~,.r-...... <br /><.<...... <:J .iO~_ .J <br /> <br />RE: Amendment #2 to CWCB/CRWCD Project Contract <br />Dear David: <br /> <br />MAY i + f9Y8 <br />-.CoJ...~dO Water <br />....lOVI\'IItion 80arrJ <br /> <br />Per our recent telephone discussion, I am writing to request that the Colorado River Water <br />Conservation District's ("District") Board of Directors, acting as the governing body of the District, <br />adopt a resolution approving the terms of Amendment #2 to the District's Project Contract with the <br />Colorado Water Conservation Board ("CWCB"), The resolution approving Amendment #2 provided by <br />the District to the CWCB was adopted by the District's Board of Directors acting as the governing body <br />of the Colorado River Water Projects Enterprise ("Enterprise"), which is owned by the District. <br /> <br />Because the District, and not the Enterprise, is a party to and executed the' Project Contract and <br />Amendment #1 to that contract, the CWCB believes that it is necessary for the District's governing body, <br />rather than the governing body of the Enterprise, to authorize the District to execute and comply with the <br />terms of Amendment #2. The heightened scrutiny of activities of West Slope districts and their <br />enterprises, brought on in part by the Campbell et al v, Orchard Mesa Irrigation District et al. lawsuit, <br />and the fact that the SecretarylManager and a director of the District also are CWCB members, both <br />support the need for complete documentation of proper authorization of the District's president to <br />execute Amendment #2, <br /> <br />Thank you tor all of your help in finalizing this contract amendment. <br />tilrther comments or questions, <br /> <br />Please call me with any <br /> <br />~' <br /> <br />LINDA 1.
