Reservoir. The 85 percent factor is a cumulative total and need not

be i~ storage at anyone point in time, if releases have been made

for Denver's use.

d. For the purposes of this Aqreement, -Firm Annual

Yield- shall be the amount of water the Reservoir could have

delivered to Denver's use over the period of the years 1954, 1955,

and 1956, divided ~ 3; provided it be assumed that the Reservoir

was full in the year 1953 but w~s drawn down thereafter to deliver

15,000 acre-feet to Denver for its use in that year, and not more,

and further assumed that the ma~imum release is limited in anyone

year to 30,000 acre-feet and the outlet capacity of the Reservoir is

not less than 300 c.f.s. The Firm Annual Yield will be determined

after all permits for construction have been obtained and the

project design completed and suc~ yield as so determined shall then

re.~ain constant throughout the term of the Lease. and shall be set

shall proceed with diligence to obtain all necessary permits and
