<br />., <br /> <br />that cannot be terminated as of the effective date of the District's dissolution; and <br />(iii) continue all sanitation service, both wastewater and storm sewer service, that is <br />currently being provided by the District. <br /> <br />The Dissolution Agreement provides that, subject to voter approval and concurrent <br />with the District's dissolution, all territory embraced by the District will be included <br />within and become a part of St. Vrain. The Dissolution Agreement further provides that <br />in order for the District to be dissolved, the eligible electors of the District must vote for <br />dissolution of the District and for inclusion of all territory lying within the District into St. <br />Vrain. A copy of the Dissolution Agreement is on file and available for inspection at the <br />Weld County District Court at the address set forth above, and at the offices of the <br />District located at 318 Fourth Street, Frederick, Colorado 80530. <br /> <br />The District has an outstanding long-term financial obligation that consists of a <br />loan from the Colorado Water Conservation Board evidenced by a Promissory Note dated <br />September 9, 2003 and payable to the Colorado Water Conservation Board in the original <br />principal amount of $2,002,400. The Promissory Note bears interest at the rate of 5% per <br />annum and is due August 1,2034. The Petition states that pursuant to the Dissolution <br />Agreement, St. Vrain will either pay the Promissory Note in full prior to the effective date <br />of the District's dissolution, or St. Vrain will assume all of the District's obligations <br />thereunder and cause the District to be released from any further liability on the <br />Promissory Note and related loan documents. The Dissolution Agreement further states <br />that, as of the effective date of the District's dissolution, the District will not have any <br />long-term financial obligations. <br /> <br />The Petition states that all short-term District financial obligations and liabilities of <br />whatsoever kind or nature will be paid by the District from its existing funds on or before <br />the effective date of the District's dissolution. <br /> <br />Subject to voter approval and in accordance with the Dissolution Agreement, <br />sanitation service, consisting of both wastewater and storm sewer service, will be <br />continued after the effective date of the District's dissolution by 8t. Vrain. The <br />Dissolution Agreement allows St. Vrain to impose rates, fees, tolls and charges for such <br />wastewater and storm sewer services, provided that those rates, fees, tolls and charges are <br />no greater than the rates, fees, tolls and charges that are generally in effect throughout St. <br />Vrain. From and after the effective date of the District's dissolution, the former <br />customers of the District will be billed directly by St. Vrain for all wastewater and storm <br />sewer services at rates as set forth by 8t.
