AL T A Lqan Policy - Form 1 <br />Schedule B - Part 1 <br /> <br />SCHEDULE B <br /> <br />File No. FA4923 <br /> <br />Policy No. CW-4817424 <br /> <br />EXCEPTIONS FROM COVERAGE <br /> <br />This Policy does not insure against loss or damage (and the Company will not pay costs, attorneys' fees or expenses) which <br />arise by reason of: <br /> <br />PART I <br /> <br />Section One <br /> <br />I. Taxes or assessments which are not shown as existing liens by the records of any taxing authority that levies taxes or <br />assessments on real property or by the public records. <br /> <br />2. Any facts, rights, interest or claims which are not shown by the public records but which could be ascertained by an <br />inspection of said land or by making inquiry of persons in possession thereof. <br /> <br />3. Easements, or claims of easement or encumbrances which are not shown by the public records. <br /> <br />4. Discrepancies, conflicts in boundary lines, shortage in area, encroachments, or any other facts which a correct survey <br />would disclose, and which are not shown by public records. <br /> <br />5. Unpatented mining claims; reservations or exceptions in patents or in acts authorizing the issuance thereof; water rights, <br />claims or title to water. <br /> <br />6. Any lien, or right to a lien, for services, labor or material theretofore or hereafter furnished, imposed by law and not <br />shown by the public records. <br /> <br />Section Two <br /> <br />I. "... and there is reserved from the lands hereby granted, a right-of-way thereon for ditches or canals constructed by the <br />authority of the United Slates. Excepting and reserving, however. to the United States all the coal and other minerals in <br />the lands so entered and patented together with the right to prospect for, mine and remove the same pursuant to the <br />provisions and limitations of the Act of December 29,1916 (39 Stal., 362)", as reserved in United States Patent dated <br />April 19, 1926 and recorded November 13, 1929 in Book 68 at Page 355, and any and all assignments thereof or <br />interests therein. <br /> <br />2. "Excepting and reserving to the grantors, their heirs and assigns an undivided one-half (1/2) of their present interest in <br />and to all oil, gas and other minerals in, on and beneath the above-described premises", as reserved by L.T. Boyer and <br />Jean Dallas Boyer in the Deed to R. Edward Spicer, recorded September 2,1947 in Book 144 at Page 23, and any and <br />all assignments thereof or interests therein. <br />NOTE: At the date of the above conveyance, said LT. Boyer and Jean Dallas Boyer were the <br />owners of an undivided 1/2 interest in and to the subject property. <br /> <br />3. "Excepting and reserving to R. Edward Spicer all of his present undivided right, title and interest in and to the oil, gas, <br />coal and other minerals of any kind or character, and to Roy E. Spicer an undivided one-half (1/2) interest of his present <br />right, title and interest in and to all oil, gas, coal and other minerals of any kind or cbaracter whatsoever in and to the <br />above-described premises; it being the intention ofthe parties hereto that the ownership of mineral rights in and to the <br />above-described lands shall stand as follows: R. Edward Spicer - 25%, Roy E. Spicer - 25%, Martin Cull - 25%, L.T. <br />Boyer and Jean Dallas Boyer - 25%", as reserved in the Deed to Martin Cull and Reta Cull recorded February 16, 1950 <br />in Book 160 at Page 382, and any and all assignments thereof or interests therein. <br />
