<br />.- <br /> <br />." <br /> <br />GRANT CONTRACT <br />Santa Haria Reservoir Company <br />Feasibility Study <br /> <br />WHEREAS, the Grantee is a duly organized Colorado nonprofit Mutual Reservoir Company <br />fonned under Section 7-42-101 et. seq. c.R.S., in the State of Colorado; and <br /> <br />WHEREAS, the Colorado Water Conservation Board approved, at their January 19, 1994 <br />meeting, a grant to the Grantee in a maximum amount of Thirty Thousand Dollars ($30,000), not <br />to exceed fifty percent (50%) of the total study cost, to conduct said Feasibility Study; and <br /> <br />WHEREAS, pursuant to the provisions of section 8, Senate Bill 94-029, the Colorado <br />General Assembly specifically authorized said grant to the Grantee. <br /> <br />NOW THEREFORE, it is hereby agreed that: <br /> <br />The captions and headings contained in this contract are for convenience and <br />reference only and shall not be construed so as to define or limit the terms or provisions <br />contracted here in. <br /> <br />1. (Grantee's consultant to Prepare Feasibility Report): The Grantee shall have a <br />Feasibility Report prepared on The Project. The State has approved a proposal for the project <br />Feasibility Report prepared by Grantee's Consulting engineer, HARZA Northwest, Inc. (the <br />Consultant). The Cost Estimate to complete the Feasibility Study, as included in page 1 of this <br />proposal is. $46,600. This proposal is attached hereto ;35 Appendix A and made a part of this <br />contract. <br /> <br />2. (Final Feasibility Report is due in one year): Three (3) copies of the fmal report <br />of the Feasibility Study prepared in compliance with the Consultant's proposal, as set forth in <br />Appendix A, shall be furnished to the State not later than November 30, 1995, unless such time <br />is extended by mutual agreement of the parties hereto in writing. <br /> <br />3. (The State will Grant money to do the Feasibility Report): The State shall grant <br />the Grantee monies to pay for the services of the Grantee's drilling contractor and for the <br />Grantee's Consultant to prepare the final report of the Feasibility Study. The State shall grant <br />to the Grantee 50% of the total cost of the study, the maximum sum not to exceed Thirty <br />Thousand Dollars ($30,000), in the manner following: <br /> <br />3a. (Grantee submits statements of costs): Throughout the time of preparation of the <br />Feasibility Study, the Grantee shall prepare statements of the costs of the Feasibility <br />Study, and shall forward said statements, along with invoices from the Grantee's <br />Consultant and the Grantee's drilling contractor, to the State. Said statements shall <br />indicate task(s) upon which work has been perfonned, and the percentage completion of <br />each task, by task number as specified in page J. of Appendix A. <br /> <br />Page 2 of 7 Pages <br />
