CO 81144 <br /> <br />_hereinafter referred to as the grantee/Grantee/Contractor. <br /> <br />WHEREAS, authority exists in the Law and Funds have been budgeted, appropriated and <br />otherwise made available and a sufficient unencumbered balance thereof remains available for <br />payment in Fund Number 424, Organization YYYY ,Appropriation "33 , Program <br />WTRC, Object Code 5/'20 , Contract Encumbrance Number; C /63 ~ 8'0 <br />and <br />WHEREAS, required approval, clearance and coordination have been accomplished from <br />and with appropriate agencies; and <br /> <br />WHEREAS, pursuant to the provisions of section 37-60-119, Colorado Revised Statutes, <br />as amended, the State is authorized to loan money for the construction or implementation of <br />certain water projects for the benefit of the people of the State of Colorado; and <br /> <br />WHEREAS, pursuant to the provisions of section 37-60-122(I)(c), Colorado Revised <br />Statutes, as amended, the Colorado Water Conservation Board is authorized to expend moneys <br />for feasibility investigations or studies, and <br /> <br />WHEREAS, pursuant to the provisions of section 37-60-121(I)(b)(IV), Colorado Revised <br />Statutes, as amended, the Colorado Water Conservation Board is authorized to make grants only <br />when specifically authorized by the General Assembly acting by bilI, and <br /> <br />WHEREAS, Grantee has made application to the State for a Grant to conduct a Feasibility <br />Study to evaluate alternatives for the repair of the Continental Reservoir Dam to include, but not <br />limited to, remedial measures that will effectively reduce or eliminate embankment seepage; such <br />repair work hereinafter sometimes referred to as The Project; and <br /> <br />Page I of 7 Pages <br />
