Fetcher: <br /> <br />The Upper Yampa Water Conservancy District constructed the Stagecoach Dam and <br />Reservoir with funds provided, in part, from a SRPA loan from the Bureau of <br />Reclamation. In administration of that contract, it became apparent that some <br />clarification of the language was needed. <br /> <br />On June 16, 1993, staff members from the Grand Junction Projects Office met <br />with you to discuss this matter. It was determined that the following <br />clarification was needed: <br /> <br />Change the subarticle reference at the end of Article ll(h) from <br />"subarticle(f)(4)" to "subartic1e(f)(2)." <br /> <br />As you know, the SRPA was amended by Section 223 of the Reclamation Reform Act <br />of 1982 (RRA) to raise the acreage entitlements for contracts under SRPA. <br />However, prior to the signing of your repayment contract, the acreage <br />entitlement of SRPA was again amended. For SRPA contracts in progress during <br />that time, the entities were allowed to choose which entitlements would apply <br />to their contract. The option chosen by your organization was the lower <br />. interest rate, which brought with it the lower acreage entitlement. Because <br />of the timing of the amendments and the finalizing of your repayment contract, <br />certain language concerning the RRA was not removed from the contract prior to <br />~Ignature. Therefore, It Is appropriate that your repayment contract be <br />clarified to reflect these changes. Those changes are as follows: <br /> <br />In Artl cle 11 (l), remove the reference "Provided, however, That acreage <br />limitations laws, particularly the Reclamation Reform Act of 1982 (RRA) , <br />are being enforced and prepayment is not being used to circumvent acreage <br />limitation laws." <br /> <br />In Article 26, omit the words "land leasing". <br />
