<br />WHEREAS, pursuant to the provisions of 37-60-119, Colorado
<br />Revised Statutes, as amended, the State is authDrized to construct
<br />certain water projects for the benefiu of the peDple of the State;
<br />and
<br />
<br />WHEREAS, the Contractor is a statutory town in the State of
<br />Colorado and wishes to construct a flood control project,
<br />hereinafter called the project, for the citizens of the Town of
<br />Erie in Weld County, Colorado, at an estimated cost of six Hundred
<br />Fifty Thousand One Hundred Fifty Dollars ($650,150); and
<br />
<br />WHEREAS, a feasibility investigation of said project was
<br />conducted and it was found that such a project is econDmically
<br />feasi'ble; and
<br />
<br />WHEREAS, the state has agreed to construct said project and to
<br />sell the same to the Contractor upon mutually agreeable terms and
<br />conditions, subject to the availability of funding for that
<br />purpose; and
<br />
<br />WHEREAS, pursuant to Senate Bill No. 439, Fifty-Third General
<br />Assembly of the State of ColDrado, duly enacted into law, the
<br />state has been authorized to expend a sum not to exceed Three
<br />Hundred Thirteen Thousand Five Hundred Thirty Dollars ($313,530)
<br />for the construction'of the project;
<br />
<br />NOW THEREFORE, in consideration of the mutual and dependent
<br />covenants herein contained, it is agreed by the parties hereto as
<br />follows:

<br />A. The Contractor agrees that it shall:
<br />
<br />1. Pursuant to State statues, take Dr has taken all necessary
<br />actions consistent therewith to adopt an ordinance authorizing the
<br />Contractor to contract this flood control project loan and to pay
<br />the annual indebtedness. Such ordinance is attached hereto as
<br />Exhibit A.
<br />
<br />2. Pursuant to State statues, through its town board, take
<br />all necessary actions consistent therewith to fix utility fees to
<br />raise sufficient funds to pay this project loan in a specified
<br />manner and as required by the terms and conditions herein to
<br />assure repayment of tho project loan to the State. These utility
<br />monthly fees shall be placed in a "Public Works Fund" which has
<br />been established by an ordinance attached hereto as Exhibit B, In
<br />the event that the assessment(s) levied by the Contractor, or the
<br />revenues resulting therefrom, are or become insufficient to assure
<br />repayment of the state as required by the terms and conditions
<br />herein! then the Contractor, upon written notice thereof from the
<br />state, shall immediately take all necessary ,action consistent
<br />with State statutes tD raise
