Articles of Incorporation and Bylaws are included in Appendix C.

The company's facilities, built about the turn of the century, are located in Weld County,
Colorado near Galeton. The company is a ditch company which owns no water rights and no
reservoirs. Their facilities consist of approximately 12 miles of supply ditch and the associated
hydraulic structures. The map in Appendix A shows the location of the supply ditch owned and
operated by the Company including the portions labeled Owl Creek and the Branch. The
stockholders in the Company own water through their stock in the Larimer and Weld Irrigation
Company, the Larimer and Weld Reservoir Company, the Windsor Reservoir and Canal
Company, and also CBT water. The water is delivered through the Owl Creek System which is
an extension of the Eaton Ditch.

The Company was incorporated in June 1905 and the construction on the ditch began on December
4, 1905. The ditch was completed sometime in 1906 when water was first run in the ditch. The
ditch was constructed by Knowlton-Bollen Construction. The work was contracted on a unit price
basis as follows.

Hard Rock Excavation
Loose Rock Excavation
Earth Excavation

$0.70/yard
$0.45/yard
$0. 12/yard

PROJECT SERVICE AREA

The service area of the Owl Creek Supply & Irrigation Company includes approximately 12,000
acres of which approximately 10,000 is planted in crops or pasture.
