NOW THEREFORE, it is hereby agreed that 1. Consideration for this Amendment to the Original Contract consists of the Qayments that shall be made pursuant to this Amendment and the Original Contract, as amended, and the promises and agreements herein set forth. 2. It is expressly agreed by the parties that this Amendment is supplemental to the Original Contract, as amended, and all terms, conditions, and provisions thereof, unless specifically modified herein, are to appiy to this Amendment as though they were expressly rewritten, incorporated, and included herein. 3. It is agreed the Original Contract, as amended is and shall be modified, altered, and changed in the following respects only: a. Paragraph A.11 is modified by the addition of the following sentences: The CWCB hereby agrees to provide a request for release of deed of trust and release, attached hereto as Appendix 1 and incorporated herein to release to the Contractor the Twin Lakes Dam and Reservoir encumbered by the deed of trust dated May 8, 2000, in consideration of the Contractor providing the Hayden Lake as substitute collateral to assure repayment of the loan. The substitute collateral for this loan, as evidenced by the Deed of Trust dated February 1, 2002, executed by the Contractor, attached as Appendix 2 and incorporated herein, shall be an undivided one hundred percent (100°/a) interest in Hayden Lake, as more particularly described in the attached Deed of Trust, hereinafter referred to as "collateral." 4. Except for the SPECIAL PROVislorvs, in the event of any conflict, inconsistency, variance, or contradiction between the provisions of this Amendment and any of the pl'OVISiOCIS Of the ORIGINAL CONTRACT, the provisions of this Amendment shall in all respects supersede, govern, and control. The SPecia� PROVisiorvs shall always be controlling over other provisions in the contract or amendments. Financial obligations of the state payable after the current fiscal year are contingent upon funds for that purpose being appropriated, budgeted, and otherwise made availabie. 6. This amendment shall not be deemed valid or effective until it shall have been approved by the controller of the State of Colorado or such assistant as he may designate.
