Box 21 <br />Cedaredge, CO 81413 <br /> <br />RE: Water Rights Utilized in Connection with <br />The Cedaredge Fisheries <br /> <br />Dear Mr. Niblack: <br /> <br />Pursuant to your request, I have investigated the water <br />rights which you will be receiving with your purchase of the <br />Cedaredge Fish Hatchery at Cedaredge, Colorado from the State of <br />Colorado's Division of wildlife. In connection with my <br />examination, I reviewed all of the documents which you furnished <br />me which relate to the early history of the water rights from <br />1921 to 1926 and examined the two plats of Cedaredge Fish <br />Hatchery system described as follows: <br /> <br />A. Map of the Cedaredge Fish Hatchery Seepage Collection <br />and Storage Area, Delta, Colorado dated June, 1967; <br /> <br />B. Cedaredge Spring Gathering Line dated March, 1951. <br /> <br />Each of the above described maps were utilized to <br />claims in the Water Court for Water District No. 40, <br />Colorado. In that connection, on December 16, 1986 <br />the records of the Office of the State Engineer, <br />Colorado, located in Montrose, Colorado in order to <br />whether or not the systems described on the plats had <br />resulted in absolute decrees in the Water Court. <br /> <br />initiate <br />State of <br />I examined <br />State of <br />determine <br />in fact <br /> <br />From my examination I conclude that with the property which <br />you are purchasing, you are entitled to receive water rights <br />consisting of the Cedaredge Fish Hatchery Seepage Collection and <br />Storage Area No.1 for a storage right of 3.91 acre feet of water <br />together with the right entitled Cedaredge Spring Gathering Line <br />for 3.0 cubic feet of water per second of time from a decree <br />entered in 1963 and an additional 2.0 cubic feet of water per <br />second of time under Absolute Fish Culture Priority No. 16. <br /> <br />The rights are described as follows as far as the 1969 <br />decree is concerned: Structure No. L-13 is the Combined Storage <br />and Collection system.
