C. loannides, P.E. <br /> <br />Re: Contract between Paradox Valley Water Conservancy District and Colorado <br />Water Conservation Board <br /> <br />Dear Mr. McDonald: <br /> <br />In regard to the above-referenced contract approved by the Paradox Valley <br />Water Conservancy District at their meeting on August 7, 1985, please be <br />advised as follows: <br /> <br />1. The signatures of Dale Phippeny, President, and Clint Oliver, <br />Secretary, representing the Paradox Valley Water Conservancy District, are <br />those persons duly appointed by the Board (see attached Exhibit "A"). <br /> <br />2. The persons signing for the Paradox Valley Water Conservancy <br />District have been duly elected by the Board to act in their representative <br />capacities (see attached Exhibit "B"), have the authority to bind the District, <br />C.R.S., ~37-45-118(h), Bylaws, Art. II, ~2 (see Exhibit "C"). and that the <br />contract has been approved at a Paradox Valley Water Conservancy District (see <br />Exhibit "D"). <br /> <br />3. The Board of the Paradox Valley Water Conservancy District has the <br />authority to enter into the contract without a vote of its residents as this <br />contract comes within the "water supply exception" of the Colorado <br />Constitution, Art. XI, ~6, C.R.S., ~37-45-118(h). <br /> <br />4. <br />District <br />contract <br /> <br />There are no provisions in the Paradox Valley Water Conservancy <br />charter nor in state or other legislation which would prevent this <br />from binding the Paradox Valley Water Conservancy District. <br /> <br />5. The contract approved August 7, 1985, will be valid and binding <br />against the Paradox Valley Water Conservancy District if entered into by the <br />State of Colorado. <br />
