Ioannides, P.E., Chief <br />project Planning and Construction Section <br />Colorado Water Conservation Board <br />721 State Centennial Building <br />1313 Sherman Street <br />Denver, CO 80203 <br /> <br />Dear Mr. Ioannides: <br /> <br />Pursuant to your request, I have examined proposed <br />Contracts between the Colorado Water Conservation Board <br />and the Sedgwick-Sand Draws Watershed Conservation <br />District, dated March 1, 1987 and dated March 2, 1987. <br />Both Contracts have been duly signed by Mr. Kish Otsuka <br />as President of the District and have been attested to by <br />Wallace G. McClary, as Secretary of the District. The <br />signatures are authentic and each individual has been <br />officially appointed to his respective position as <br />indicated in the signature block of the Contracts. <br /> <br />Mr. Otsuka as President of the Board has the <br />authority to bind the entity and the Contracts in <br />question have been validly approved by the District's <br />Board of Directors. A copy of the minutes of the meeting <br />approving the two Contracts are attached. <br /> <br />The governing body of the District has the <br />authority to enter into these Contracts without a vote of <br />its residents. The District pursuant to C.R.S. 37-5-106 <br />has the authority to issue Conservancy Bonds and to repay <br />the same by making assessment levies as is provided in <br />the statutes. In lieu of said bonds, the District is <br />borrowing funds from the Colorado Water Conservation <br />Board and shall repay said loan by the collection of <br />assessment levies. The assessments have already been <br />approved by the Sedgwick County District Court. <br />
