Ioannides, P.E., Chief project Planning and Construction Section Colorado Water Conservation Board 721 State Centennial Building 1313 Sherman Street Denver, CO 80203 Dear Mr. Ioannides: Pursuant to your request, I have examined proposed Contracts between the Colorado Water Conservation Board and the Sedgwick-Sand Draws Watershed Conservation District, dated March 1, 1987 and dated March 2, 1987. Both Contracts have been duly signed by Mr. Kish Otsuka as President of the District and have been attested to by Wallace G. McClary, as Secretary of the District. The signatures are authentic and each individual has been officially appointed to his respective position as indicated in the signature block of the Contracts. Mr. Otsuka as President of the Board has the authority to bind the entity and the Contracts in question have been validly approved by the District's Board of Directors. A copy of the minutes of the meeting approving the two Contracts are attached. The governing body of the District has the authority to enter into these Contracts without a vote of its residents. The District pursuant to C.R.S. 37-5-106 has the authority to issue Conservancy Bonds and to repay the same by making assessment levies as is provided in the statutes. In lieu of said bonds, the District is borrowing funds from the Colorado Water Conservation Board and shall repay said loan by the collection of assessment levies. The assessments have already been approved by the Sedgwick County District Court.
