<br />WHEREAS. required approval, clearance and coordination has been accomplished from and with appropriate
<br />agencies: and
<br />
<br />WHEREAS, the State and the Contractor did on December 1,
<br />1981, enter. into a cont ract for state participation in the
<br />improvements of the exist,ing water sopply system of the Town of
<br />Basalt, in Eagle County Colorado, which contract is attached
<br />hereto as Exhibit A and is hereby incorporated hereini. and
<br />
<br />WHEREAS, the construction bids received enabled the
<br />Contractor to complete the project described in that certain
<br />contract dated December 1,- 1981, at a cost less than what was
<br />originally anticipated. ~
<br />
<br />NOW, THEREFORE, in consideration of the mutual and
<br />dependent covenants herein contained, it is agreed by the
<br />parties hereto as fol~ows:
<br />
<br />1. The terms and provisions of paragraphs A.12., C.l. and I.
<br />of that certain con-tract dated December 1, 1981, att'ache'd
<br />hereto as Exhibit A and incorporated herein.by reference are
<br />hereby amended to read as foLlows:

<br />at ~ total purchase price of Four fh..tndred Sixty-Three
<br />Seven Hundred Twenty-Three Dollars and Sixty Cents
<br />($463,72J.60), payable in forty (40) annual installments of
<br />Eleven Thousa.nd Five Hundred Ninety-Three Dollars and Nine
<br />Cents (~11,593.09) eacn, which first installment shall be due
<br />and payable on December 1, 1983, and yearly thereafter until
<br />the entire prinCipal sum shall have been paid. Said
<br />installment payments shall be made payable to the Colorado
<br />Water Conservation Boaru, payable at the offices of the said
<br />Board in Denver, Colorado.

<br />Cents ($226,975 .24). Said Two Hundred Twenty-Six Thousand Nine
<br />Hundred Seventy-Five Dollars and Twenty-Four Cents
<br />($226,975.24) shall he made available to the Contractor in
<br />accordance with the following terms and conditions:

<br />a. Beginning with t11e monthly periOd commencing
<br />February 1, 1981, and for every month thereafter
<br />until said project has been completed, the Contractor
<br />shall prepare with the assist_ance of the consulting
<br />engineer referred to in paragraph A .1.- above an
