r .. <br />`� <br />V. TERMINATION <br />This License is effective until terminated. This License <br />or any corresponding Sub-License will terminate automatically <br />without notice from Hydrosphere if Licensee or its Sub-Licensee <br />fails to comply with any provision of this License. Upon termi- <br />nation of this License, Licensee shall return all copies of the <br />Software in its possession to Hydrosphere and shall notify all <br />Sub-Licensees that this License has been terminated and that all <br />copies of the Software in the possession of Sub-Licensees should <br />be returned to Hydrosphere. In the event of termination of a <br />Sub-License, the Sub-Licensee shall return all copies of the <br />Software in its possession to Hydrosphere. <br />VI . INDF�IIFICATION <br />Licensee and its Sub-Licensees recoqnize that the conver- <br />sion of the Software from the aomputing system and format on <br />which it may be installed by Hydrosphere, at the time of accep- <br />tance of the Software by Licensee, to an alternate system or for- <br />mat may result in the introduction of errors and anomalies. In <br />the event the Software is so converted subsequent to acceptance <br />by Licensee, Licensee assumes all risks associated therewith and <br />agrees to release Hydrosphere from liability therefrom. <br />Licensee and its Sub-Licensees recognize that use of or <br />modifications of the Software by anyone other than Hydrosphere <br />may result in adverse consequences which Hydrosphere can neither <br />predict or control. Therefore, in consideration of Hydrosphere's <br />agreement to deliver the Softwdre, Licensee and its Sub-Licensees <br />agree to release Hydrosphere from liability therefrom. The fore- <br />going agreement to release Hydrosphere applies to any use of the <br />Software other than for any claims, liabilities, losses, damages, <br />and costs, including but not limited to attorneys fees, arising <br />out of or in any way connected with infringement of patent <br />rights, copyrights, trademarks, or any other proprietary rights. <br />Because of the possibility that, after delivery thereof, <br />the Software may be altered, whether inadvertently or otherwise, <br />Hydrosphere reserves the right to retain copies of the Software <br />as originally delivered, which originals shall be referred to and <br />shall govern in the event of any inconsistency between the two. <br />VII. LIMTTED WARRANTY <br />This Software is an exact copy of the final version of the <br />-3- <br />
