4.1 WATER RIGHTS

The water rights for the various reservoirs in the Windsor Reservoir and Canal Company
system, their respective priorities, gage heights, and storages are listed in Table 4-1. A
copy of the decree for Douglas Reservoir (aka Douglas Reservoir and Reservoir No. 10)
is attached as Appendix C.

Presently Douglas Reservoir is drawn down to zero gage height for dam safety
considerations although a restriction has not been issued by the Colorado State
Engineer's Office.

Water rights transfers or exchanges were not deemed possible by the Windsor Reservoir
and Canal Company as an alternative for rehabilitation. All existing dams and reservoirs
which could accept water presently flowing into Douglas Reservoir are operating at
capacity. Therefore, transferring water rights or exchanges are not an option unless new
facilities (such as a new dam) are constructed in the project area.

4.2 WATER UTILIZATION

Douglas Reservoir is located on Dry Creek, a tributary of Cache LaPoudre River, in
Larimer County. According to the U.S. Corps of Engineers Phase I Inspection Report,
July 1978, the drainage at the dam is 46.4 square miles including 5.1 square miles above
Park Reservoir and 1.7 square miles above Reservoir No.15. The outflow from both of
these reservoirs empties into Douglas Reservoir. The reservoir is supplied primarily by
the Poudre Valley Canal with supplemental inflow from the Dry Creek drainage.

Water from Douglas Reservoir is exchanged with the Water Supply and Storage
Company (WSSC) as the reservoir does not empty into canals utilized by the Windsor
Reservoir and Canal Company. In exchange for the Douglas Reservoir water, the
