<br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />4.0 PERMIT REQUIREMENTS, ENVIRONMENTAL CONSTRAINTS AND <br />RIGHT-OF-WAY ACQUISITION <br /> <br />4.1 <br /> <br />GENERAL <br /> <br />Construction of a reservoir on Snowball Creek would affect both public <br />and private lands. The majority of the reservoir site lies within the <br />Macht Ranch. The dam site is within the San Juan National Forest, which is <br />public land administered by the U.S. Forest Service. Land ownership is <br />shown on sheets 9 through 13 of the drawings found in Appendix B. <br /> <br />Private land for the reservoir and easements through private land for <br />the canal and pipeline would need to be purchased. Only two land holders <br />would be involved in such negotiations. <br /> <br />4.2 <br /> <br />PERMIT REQUIREMENTS <br /> <br />A special use permit for construction, operation, and maintenance of <br />the dam would have to be obtained from the U.S. Forest Service. The use <br />permits would be for the dam, ditch, and pipeline. The application would <br />include preliminary design drawings for all construction. Engineers with <br />the Forest Service would review the design of the dam in conjunction with <br />the Colorado State Engineers Office. An environmental analysis of the <br />proj ect would also be prepared by the Forest Service. This may require <br />consultation with the U.S. Fish and Wildlife Service (USFS), concerning <br />impacts on threatened and endangered species. <br /> <br />The U. S. Army Corps of Engineers (COE) would review the proj ect to <br />determine the extent of wet lands that may be affected. Snowball Creek is <br />not included on the list of headwater streams within the jurisdiction of <br />the COE. However, a 404 Permit would still be required if more than ten <br />acres of wetlands are involved. The Colorado State Department of Health" <br />would have to certify the permit before it could be issued by the COE. <br /> <br />4-1 <br />
