I
I
I
I
I
I
I
I
I
I
I
I
I
I
I
I
I
I
I

4.0 PERMIT REQUIREMENTS, ENVIRONMENTAL CONSTRAINTS AND
RIGHT-OF-WAY ACQUISITION

4.1

GENERAL

Construction of a reservoir on Snowball Creek would affect both public
and private lands. The majority of the reservoir site lies within the
Macht Ranch. The dam site is within the San Juan National Forest, which is
public land administered by the U.S. Forest Service. Land ownership is
shown on sheets 9 through 13 of the drawings found in Appendix B.

Private land for the reservoir and easements through private land for
the canal and pipeline would need to be purchased. Only two land holders
would be involved in such negotiations.

4.2

PERMIT REQUIREMENTS

A special use permit for construction, operation, and maintenance of
the dam would have to be obtained from the U.S. Forest Service. The use
permits would be for the dam, ditch, and pipeline. The application would
include preliminary design drawings for all construction. Engineers with
the Forest Service would review the design of the dam in conjunction with
the Colorado State Engineers Office. An environmental analysis of the
proj ect would also be prepared by the Forest Service. This may require
consultation with the U.S. Fish and Wildlife Service (USFS), concerning
impacts on threatened and endangered species.

The U. S. Army Corps of Engineers (COE) would review the proj ect to
determine the extent of wet lands that may be affected. Snowball Creek is
not included on the list of headwater streams within the jurisdiction of
the COE. However, a 404 Permit would still be required if more than ten
acres of wetlands are involved. The Colorado State Department of Health"
would have to certify the permit before it could be issued by the COE.

4-1
