<br />I <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />The Waneka Darn construction drawings were filed with the State Engineer's <br /> <br /> <br />Office (SEO) around 1903. The darn was apparently enlarged by this filing and <br /> <br /> <br />the date of first construction is not known. One of the first inspection re- <br /> <br /> <br />ports indicating potential problems with the facility was filed in August 1977. <br /> <br /> <br />The report questioned the stability of the embankment and requested verification. <br /> <br /> <br />Subsequent inspection reports identified other problems and a storage restriction <br /> <br /> <br />was issued on May 23, 1979 by the SED. The restriction limited the storage <br /> <br /> <br />to 3 feet below the spillway crest until repairs to the embankment and construc- <br /> <br /> <br />tion of an adequate spillway are made. The storage restriction reduces the <br /> <br /> <br />total available storage from 604 AF to 420 AF (184 AF reduction). <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />B. Powers and Authorities <br /> <br />I <br /> <br />Pursuant to the provisions of Article 40, Title 7, CRS 1973, and the <br /> <br /> <br />articles of incorporation, the HWMRC has the statutory powers of a non-profit <br /> <br /> <br />corporation. The purpose of the reservoir company is to store water exclusively <br /> <br /> <br />for the benefit of its stockholders to irrigate their lands and for such other <br /> <br /> <br />uses as are customary, thereby promoting the convenience and benefit of the stock- <br /> <br /> <br />holders in irrigating their lands, including their leased lands. The articles <br /> <br /> <br />of incorporation, however, limit the purpose such that the corporation shall <br /> <br /> <br />never operate as a public ditch or reservoir company or store or carry water <br /> <br /> <br />for profit. Some of the specific powers are stated below: <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />I - To acquire, purchase, appropriate, and obtain by other legal means <br /> <br /> <br />water and water rights, direct and storage water priorities, and <br /> <br /> <br />stock in mutual and public ditch companies. <br /> <br />I <br /> <br />2 - To hold, purchase, mortgage, lease, and convey real and personal <br />property of any nature whatsoever, including shares of stock in any <br />mutual or public ditch company, water rights, deeds, water priorities, <br />ditch easements, right-af-way, reservoirs, water storage, and <br /> <br />I <br /> <br />I <br /> <br />according to the provisions of the By-Laws. <br /> <br />I <br /> <br />I <br /> <br />-9- <br />
