A. History

I

The Henry Waneka Mutual Reservoir Company (HWMRC) was organized on March
12, 1959 by a petition filed in the Boulder County Court. The company was
organized under State Statutes 1973 CRS 7-41-010 et seq. for Special Purpose
Corporations, not for profit. The HWMRC purchased the Miller and Harmon
Reservoir from the Public Service Company on June 2, 1959 and the reservoir
was renamed the Waneka Reservoir.

Four different storage rights for Waneka Reservoir have been secured

in two separate adjudications. Specific information related to these rights

The reservoir was originally owned by the Northern Colorado Power Company

until 1914, when the name was changed to the Western Power and Light Company.

In 1923, all of Western's holdings were consolidated with other power companies

to form the Public Service Company of Colorado. All of the Public Service

Company's interests were conveyed by a warranty deed and quit claim deed to the

HWMRC on September 30, 1959. Smaller portions of the interests in the reservoir

were held by various individuals throughout the period.
