<br />. <br /> <br />. <br /> <br />intends to take water from the Florida River, at or near a point <br />on the Florida River lying in the NW/4SE/4, Section 2, Township <br />33 North, Range 9 West, N.M.P.M., being 1,950 feet north of the <br />south section line 'and 225 feet east of the west section line of <br />said section; to construct a reservoir, and to construct a <br />pipeline running from said point to the reservoir and from said <br />point and said reservoir to members' real property (and the real <br />property of such nonmembers, including without limitation <br />noncontiguous property owners, as may be determined by this <br />nonprofit corporation in accordance with these articles and the <br />bylaws of this nonprofit corporation). Said point, reservoir, <br />pipeline and real property are intended to be all or primarily on <br />lands depicted on the map attached hereto as Exhibit A. The uses <br />to which xhe water is intended to be applied are rural domestic <br />use for indoor and outdoor purposes including irrigation, fire, <br />protection, dust control, livestock watering and other beneficial <br />uses consistent with rural residences which shall not exclude <br />commercial use if otherwise permissible under local, state and <br />federal law and the articles and bylaws of this nonprofit <br />corporation. <br /> <br />ARTICLE XIII <br /> <br />This nonprofit corporation ~hall have the power to fix, <br />levy, charge, collect and enforce by any lawful means (in <br />accordance with these articles, the bylaws of this nonprofit <br />corporation, and applicable law) charges and assessments (whether <br />general or special) to cover past or future costs and expenses in <br />connection with the purposes of this nonprofit corporation. <br /> <br />The undersigned, acting as Lncorporators of this nonprofit <br />corporation, hereby declare that they are eighteen years of age <br />or older and adopt these article~ of incorporation effective as <br />of February ~, 1996. <br /> <br />~ tl/U,y tL(1a~ <br />'. {j?-W,~ I1fll //-,./ ;! <br />warm!
