<br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />The Colorado Squawfish, which is currently listed as an endangered species, is not present in this <br />section of the Colorado River due to a downstream dam near Cameo. The Squawfish is generally <br />present 2 to 3 miles downstream from the subject site. The aquatic life which is present in this <br />section, and is proposed to be added to the endangered species list, is the Razorback sucker fish. <br />CDFW has placed a physical activity limitation on this section of the Colorado River during <br />Razorback sucker fish spawning season. The spawning season for Razorback sucker fish is during <br />the months of May and June. <br /> <br />The other endangered species present in the subject area is the Bald Eagle. The Bald Eagle is <br />found to generally nest in mature Cottonwood trees, and therefore, removal of such trees during <br />construction is not permitted. <br /> <br />The pipeline crossings of the Colorado River are proposed to be conducted during September, <br />October, and November, a time which generally presents low flow in both the Colorado River and <br />Plateau Creek. This schedule mitigates impact to the spawning of the Razorback sucker fish. The <br />proposed pipeline alignment has also been modified to avoid eradication of any mature Cottonwood <br />trees. <br /> <br />6.3.7 Denver Rio Grand Railroad <br /> <br />A section of the proposed pipeline along the west bank of the Colorado River will be located on <br />the Denver and Rio Grand Railroad (D&RGR) land. The D&RGR was contacted as part of <br />permitting process to determine their requirements for acquisition of Construction Right-of-Way. <br />The construction on D&RGR land will require a construction permit. As part of this permit, <br />drawings presenting the detail location and cross sections should be submitted to D&RGR Engineer <br />section for evaluation and approval. <br /> <br />The cost for obtaining construction Right-of-Way from D&RGR is estimated to be about $3000.00 <br />per acre per year. This will include a permanent maintenance easement. <br /> <br />6.4 Design Considerations <br /> <br />The alignment proposed by WEI was selected for design consideration evaluation. This alignment <br />appears to be appropriate except in the following areas: <br /> <br />I) In the vicinity of the Plateau Creek Information Area, WEI aligns the pipe to jog <br />around the center and continue to the north adjacent to Highway 65. The presence <br />of a grove of cottonwood trees on the alignment which cannot be removed during <br /> <br />34 <br />
