The City may divert water from a given ditch in proportion to its <br />ownership in that ditch and only when the given ditch is diverting <br />water for agricultural use. <br /> <br />2. Only those waters for which irrigation return flows have <br />historically returned to the Big Thompson River Basin may be <br />diverted by the City. <br /> <br />3. Until the City owns 100 percent of the entire quantity of water <br />decreed to and carried through a given ditch, the City may take at <br />its alternate points of diversion only 85 percent of the amount <br />owned by the City. <br /> <br />4. The City may store direct-flow water acquired from ownership in a <br />given ditch in any storage facility that is owned or controlled by <br />the City, but only during the months set forth in the following <br />table. Also, the City may store only a percentage of such water <br />as listed below: <br /> <br />Ditch Month = May June July Aug. Sept. Out of whatever amount of water stored by the City in accordance <br />with item 4 above, 13 percent must be released for use in the <br />City's municipal system during the next succeeding months of <br />November through March. The remainder of such stored water may be <br />completely consumed by the City. <br /> <br />6. The City is not limited to the terms of this Decree during the <br />times that the Big Thompson River is in a flood or "free water" <br />condition in which there are no calls on the river and all users <br />are allowed to divert without regard to priority system <br />administration. <br /> <br />8-8 <br />
