1. The City may divert water from a given ditch in proportion to its
ownership in that ditch and only when the given ditch is diverting
water for agricultural use.

2. Only those waters for which irrigation return flows have
historically returned to the Big Thompson River Basin may be
diverted by the City.

3. Until the City owns 100 percent of the entire quantity of water
decreed to and carried through a given ditch, the City may take at
its alternate points of diversion only 85 percent of the amount
owned by the City.

4. The City may store direct-flow water acquired from ownership in a
given ditch in any storage facility that is owned or controlled by
the City, but only during the months set forth in the following
table. Also, the City may store only a percentage of such water
as listed below:

5. Out of whatever amount of water stored by the City in accordance
with item 4 above, 13 percent must be released for use in the
City's municipal system during the next succeeding months of
November through March. The remainder of such stored water may be
completely consumed by the City.

6. The City is not limited to the terms of this Decree during the
times that the Big Thompson River is in a flood or "free water"
condition in which there are no calls on the river and all users
are allowed to divert without regard to priority system
administration.
