<br />WHEREAS, relluired approval. c1eOlr<lnCe and coordilliltioll ha~ been llccomplished from and with appropriate
<br />agendes: and
<br />
<br />WHEREAS, "pursuant to the provisions of 37-60-119, Colorado Revised
<br />Statutes 1973, as amended, the Colorado Water Conservation Board is
<br />authorized to construct certain water projects for the benefit of the
<br />people of the State of Colorado; and
<br />
<br />WHEREAS, the Town of Dove Creek has made application to the
<br />Colorado Water Conservation Board for the construction of a water
<br />project for the purpose of improving its municipal water supply; and
<br />
<br />WHEREAS, the Contractor is a professional engineering firm within
<br />State of ColoradO and has previously done water-related work for
<br />Town of Dove Creek and various other municipalities in Colorado;
<br />

<br />NOW THEREFORE, it is hereby agreed that
<br />
<br />1. The Contractor agrees to prepare a feasibility report directed
<br />to the problem of improving the municipal water of the Town of Dove
<br />Creek in accordance with a proposal for project feasibility report
<br />prepared by the Cont~actor and approved by the Colorado Water Conserva-
<br />tion Board, received September 7, 1976, which proposal is attached
<br />hereto as Appendix A and made a part of this contract.
<br />
<br />2, Fifteen (15) copies of the report called for in this contract
<br />shall be furnished to the State not later than November 1, 1976, unless
<br />such time is extended by mutual agreement of the parties hereto.
<br />
<br />3, As compensation for the services of the Contractor, the State
<br />agrees to pay the Contractor the sum of Five Thousand Dollars ($5,000)
<br />in the manner following:
<br />
<br />a. Sixty percent (60%), to wit, Three Thousand Dollars ($3,000)
<br />,of the total amount due in two (2) monthly installments of One Thousand
<br />Five Hundred Dollars ($1,500),each, commencing on October 15, 1976.
<br />
<br />b. The remaining forty percent (40%), to wit, Two Thousand Dollars
<br />($2,000) within thirty (30) days following receipt and acceptance of
<br />the written report specified in paragraph 2 of this contract.
<br />
<br />4. This contract is personal in nature and assignment of perfor-
<br />mance by the Contractor to another is prohibited unless prior approval
<br />in writing is granted by the State.
<br />
<br />5. The Contractor is an independent Contractor and as such is not
<br />entitled to any benefits of the State personnel system.
