Said elections <br />shall be held, and returns thereof made, and certificate, <br />in all respects as may be provided by law, in elections for <br />members of the legislature. A copy of said returns of said <br />election shall also be delivered to the probate judge of <br />Clear Creek County, and he shall canvass the same within <br />three days from the time they shall be received, and the per- <br />son receiving the highest number of votes for the several <br />offices of police judge, marshal. two selectmen from each <br />of said wards, shall be declared by the probate judge of <br />Clear Creek County duly elected to said several offices. <br /> <br />If two or more persons shall, at said election, receive the <br />same number of votes for either of said offices, the probate <br />judge shall decide the same by lot. This shall only apply <br />for the first election to be held on the fourth Tuesday of <br />January, A.D. 1868, and forever after the first election <br />the returns of the election shall be made to the board of <br />selectmen, who shall determine the election between them by <br />lot. <br /> <br />Section 2. All male inhabitants over the age of twenty- <br />one years, who are entitled to vote for members of the legis- <br />lature, and who shall have been actual residents of said cor- <br />poration ten days next preceding said election, shall be <br />entitled to vote for town officers: Provided, That said <br />voters shall vote in the wards in whiCh they shall respec- <br />tively reside. <br /> <br />ARTICLE V. <br /> <br />Section 1. The board of selectmen shall have power and <br />authority to levy and collect taxes for corporate purposes. <br />upon all taxable property, real, mixed and personal, except <br />as hereinafter excepted, within the limits of the corporation, <br />not exceeding one percent per annum upon the assessed value <br />thereof, and may enforce the payment of the same in any man- <br />ner that may be prescribed by ordinance, not repugnant to <br />the constitution of the United States or the organic act of <br />this territory. <br /> <br />Section 2. The board of selectmen shall have power to <br />require of all officers appointed or elected in pursuance <br />of this act, bonds, with penalty and security for the faith- <br />ful performance of their respective duties, as may be deemed <br />expedient, and, also, to require of all officers appointed or <br /> <br />C-5 <br />
