Denver. Colorado 80202, hereinafter referred to as the contractor, 19'82, by and belween,'he Natural Resources Company. WHEREAS, authority ex.ists in the Law and Funds have been budgeted, appropriated and otherwise made available and' a sufficient unencumbered balance thereof remains available for ~yment in Fund Number 4008 G/L Account Number 5248X. Contract Encumbrance NumberG:I.~~t; and . . . WHEREAS, required approval, clearance and coordination has been accomplished rrom and with appropriate agencies; and -, WHEREAS, section 7 of S.B. 439, 1981 Session, authorized the State to cause to be conducted a feasibility study of the Cache la poudre project, the expenditures for which study are not to exceed Three Hundred Thousand Dollars ($300,000); and WHEREAS,' the State, acting through the Colorado Water Conservation Board, has, pursuant to section 37-60-1~2(1)(c), Colorado Revised Statutes 1973, as amended, the authority to conduct such a feasibility study with monies from the Colorado Water Conservation Board construction .fund; and WHEREAS, the State does not have sufficient professional experti?e to complete said study in a timely manner; and WHEREAS, the Contractor warrants that it is a professional engineering firm which has the experience and expertise required to complete the study in a satisfactory and timely manner; and WHEREAS, section 24-30-1401, et ~., Colorado Revised Statutes 1973, as amended, 'has been .fully complied with and the certificate required of the Contractor by section 24-30-1401, et ~.~ Colorado Revised S~atutes 1973, as amended, has been -- executed by the Contractor, i~ attached hereto as Exhibit A, and by tqis reference is incorporated herein as if the same had been fully set forth in the body of this contract; NOW THEREFORE, it is hereby agreed that: 1. The Contractor shall, in consideration of the .compensation to be paid to it pursuant to paragraph 2 below, complete the study ta~ks and analyses and provide the 'products specified in Exhibit B, Scope _of Services, _which exhibit is attached hereto and by this reference incorporated herein as if the same .had been fully set forth in the body of this contract. 2.
