<br />
<br />THIS DEED is made this l.A.tl1 day of Februarv 1992,
<br />between THE TERRACE IRRIGATION COMPANY, a C~lcrado
<br />Corporation, the legal address of which is 835 First Avenue,
<br />Monte Vista, Colorado, 81144, grantor and the STATE OF
<br />COLORADO for the use and benefit of the Department of
<br />Natural Resources (Colorado Water Conservation Board) 721
<br />State Centennial Building, 1313 Sherman Street, Denver,
<br />Colorado, 80203, grantee.

<br />WITNESSETH, that the grantor, for and in consideration
<br />of the terms 1 covenants, and conditions set forth in that
<br />document designated as "Project Contract and Promissory
<br />Notell has granted, bargained, sold and conveyed and by these
<br />presents does grant, bargain, sell, convey and confirm unto
<br />the grantee its successors and assigns forever all of the
<br />grantor's interest in the real property together with
<br />improvements, if any, situate in the Counties of Conejos and
<br />Rio Grande, and State of Colorado, described as follows:

<br />The rights-af-way easements acquired from James D.
<br />Hanegan, as Trustee of the Elizabeth B. Silver Trust,
<br />Lee Banks and Carlene Banks; Leonard F. Valdez a/k/a
<br />Leonard Valdez; Ernesta Valdez Jr. a/k/a Ernest Valdez
<br />Jr. and Alfonso Valdez; and the State of Colorado
<br />acting by and through the Board of Land Commissioners,
<br />the respective descriptions of said right-of-way
<br />easements being more particularly described as follows:

<br />That easement, located in the Southwest Quarter of the
<br />Northwest Quarter and the Southeast Quarter of the
<br />Northwest Quarter of Section Twenty-seven, Township
<br />Thirty-six North, Range Seven East, New Mexico
<br />Principal Meridian, Canejos County, Colorado, and is
<br />for an irrigation lateral, the right to build and
<br />maintain said lateral, and all appurtenances thereof.
<br />
<br />The easement is 50 feet in width, being 25 feet on
<br />either side of the following described centerline, the
<br />sidelines of said easement being extended or shortened
<br />to intersect the Sixteenth or Quarter Section Lines as
<br />appropriate:
<br />
<br />Beginning at a point- on the South line of the Southwest
<br />Quarter of the Northwest Quarter of Section Twenty-
<br />seven from which the West Center Sixteenth Corner of
<br />said section (as monumented by a 30 inch long No. 6
<br />rebar with an attached 31 inch aluminum cap set by RLS
<br />#22583) bears N 89014134" E a distance of 18.03 feet;
<br />thence N 42045100" E a distance of 1834.02 feet to a
<br />point on the north line of said Southeast Quarter of
<br />the Northwest Quarter of Section Twenty-seven and the
<br />end of this description (from which the North Center
<br />Sixteenth Corner as monurnented by a 30 inch long No. 6
<br />rebar with an attached 31 inch aluminum cap set by RLS
<br />#22583 bears S 89022154" W a distance of 82.49 feet).
<br />This easement burdens 2.10S'acres, more or less.
<br />
<br />That easement, located in the Northeast Quarter of the
<br />Northwest Quarter and the Northwest Quarter of the
<br />Northeast Quarter of Section Twenty-seven, the East
<br />Half of Section Twenty-two and the Northwest Quarter of
<br />Section Twenty-three, all in Township Thirty-six North,
<br />Range Seven East, New Mexico Principal Meridian,
<br />Conejos County, Colorado, and is for an irrigation
<br />lateral, the right to build and maintain said lateral,
<br />and all appurtenances thereof.
