<br />-', <br /> <br />c. The State agrees that it will: <br /> <br />1. Make available to the Contractor for the purpose of this contract <br />the sum of 'I\..o HlUldred Seventeen Thousrlnd l):)llars ($217,000). Said 'l\o.O <br />lllU1dred Seventeen 'll1ousand Dollars ($217,000) shall be rrade available to <br />the Contractor in accordance with the follOtling tenns and conditions: <br /> <br />a. Beginning with the rronthly pericx:1 canrencing Decerrber I, <br />1980 and for every rronth thereafter \.U1til said project <br />has been crnpleted, the COntractor shall prepare with the <br />consulting engineer's help an estimate of the funds <br />required fran the State for project construction during <br />that rronth and shal] forward said estimate to the State <br />not less than fifteen (15) days prior to the beginning <br />of such rronth. <br /> <br />b. Upon receipt and approval by the State of soch m:>nthly <br />estimate, the State will, within forty (40) days fran <br />the receipt of soch esti.ma.te, pay over to the Contractor <br />the iUT'OlU1t of the rronthly estimate or such portion <br />thereof as has been approved by the State. <br /> <br />2. Assist the Contractor with such technical assistance as the State <br />deems awropriate in planning, constructing, and operating the project and in <br />CO 0 rdinating the project with local official carprehensive plans for s~r <br />and water and with any State or area plans for the area in which the project <br />is located. <br /> <br />D. In its sole discretion, the State may at any tirre give any consent, <br />deferm:mt, subordination, release, satisfaction, or tennination of any or all <br />of the Contractor's obligations under this agreement, with or without <br />valuable consideration, upon such tenns and conditions as the State may <br />detenni.ne to be (a) advisable to further the pw:poses of this contract or <br />to protect the State's financial interest therein, and (b) consistent with <br />ooth the statutory puqx:>ses of this oontract and the limitations of the <br />statutory authority under which it is made. <br /> <br />E. Upon crnpletion of thE' payrrent of the full purchase price to the State <br />in the sum of Three Hundred Seventy-Five 'lliousand Four Hundred Ninety-Six <br />Dollars and Eighty Cents ($375,496.80) as set forth in paragraph A,9. of <br />this cootract, the State agrees to convey to the Contractor all of the State I S <br />right, title, and interest in and to the project by deed or other pL....0€r <br />conveyance. <br /> <br />Page l of ~ pages <br />
