WHEREAS, authority exists in the Law and Funds have been budgeted, appropriated and otherwise made
ayailable and a sufficient unencumbered balance thereof remains ayailable for. payment in Fund Number I] 00 B ,

ABL Account Number 17680, Org. Unit 77-77-771,
WHEREAS. required approyal, clearance and coordination has been accomplished from and with appropriate
agencies; and

WHEREAS, the State and the Contractor did on December 1,
1980, enter into a contract for State participation in the
construction of the Town of Hudson water supply project for the
benefit of the Hudson residents in Weld County, Colorado, which
contract is attached hereto as Exhibit A and is hereby
incorporated herein; and

WHEREAS, the State and the Contractor underestimated the
cost of the project in that certain contract dated December 1,
1980 (Exhibit A); and

WHEREAS, the Town of Hudson proposes to build the
originally conceived project using other resources available to
it;

NOW, THEREFORE, in consideration of the mutual and
dependent covenants herein contained, it is agreed by the
parties hereto as follows:

1. The terms and provisions of that certain contract dated
December 1, 1980, attached hereto as Exhibit A and incorporated
herein by reference, remain in full force and effect except as
amended herein,

2. Paragraph A.2. is hereby amended to read as follows:

a.. A 15-inch dia., 8-inch dla. casing, 7951+ welt to he
located In the SW 1/4 or the SW 1/4, Sec:- 2, T1N,
R65W, 6th Principal Meridian.

b. Controls, housing and chlorination equipment for the
well in a..

c. A pump station, with two 300 gpm centrifugal and one
900 gpm fire flow pumps with controls ann
appurtenances to be located as in a.

All of the above are located as shown in Appendices A and
B in Exhibit A.

3. The Contractor shall Comply with Construction Fund Program
Procedures attached hereto as Schedule A.
