<br /> GRANT CONTRACT
<br /> THIS Grant Contract, made this Q3 day of P , o3, by and between the
<br /> State of Colorado for the use and benefit of the Department of Natural Resources, Colorado
<br /> Water Conservation Board, hereinafter referred to as the CWCB and/or State, and Colorado
<br /> Foundation for Water Education (Foundation), a nonprofit corporation, located at 1580 Logan
<br /> Street, Suite 410, Denver, Colorado 80203, hereinafter referred to as the Grantee or the
<br /> Contractor.
<br /> FACTUAL RECITALS
<br /> 1. WHEREAS, authority exists in the law and funds have been budgeted, appropriated and
<br /> otherwise made available, for a payment of $150,000.00, pursuant to HB 02-1152, Section
<br /> 25(1), for the operation of the Colorado Foundation for Water Education through Fund
<br /> Number 424, Organization YYYY, Appropriation Code CWC, Program WTRC, Object Code
<br /> 5781, Contract Encumbrance No. C150097.
<br /> 2. WHEREAS, pursuant to Contract Number No. C150097, CWC received and spent the
<br /> initial grant funds, in the amount of $250,000.00, to establish the Foundation, which is
<br /> fully operational.
<br /> 3. WHEREAS, state statute expressly authorize and annually appropriates $150,000.00 from
<br /> the Construction . Fund to the Foundation on July 1 of each fiscal year as a non-
<br /> reimbursable grant (Section 37-60-121(1)(b)(IV), C.R.S.), as provided by 2002 Colo Sess.
<br /> Laws, Ch 150, Sec. 25(2) at 455, H.B. 02-1152, sec 25 (2).
<br /> 4. WHEREAS, this Contract between CWCB and the Foundation replaces Contract Number
<br /> No. C150097.
<br /> 5. WHEREAS, the grant of funds provided for by this contract will promote a better
<br /> understanding of water issues through educational opportunities and resources so
<br /> Colorado citizens will understand water as a limited resource and will make informed
<br /> decisions.
<br /> 6. WHEREAS, the State may set annual terms and conditions on the expenditure of funds.
<br /> 7. WHEREAS, the Foundation will perform the Scope of Work agreed to in Attachment 1 and
<br /> will make periodic reports to the CWCB about its activities.
<br /> 8. WHEREAS, CWCB retains its authority to review the purposes of H.B.02-1152, Section
<br /> 25, annually and may cease providing moneys in the year following notice to CWC and
<br /> the Foundation if the CWCB in its discretion determines the purposes of Section 25 have
<br /> ceased to be met by the Foundation.
<br /> 9. WHEREAS, required approval, clearance, and coordination have been accomplished from
<br /> and with appropriate agencies.
<br /> NOW THEREFORE, in consideration of the mutual and dependent covenants contained
<br /> herein, the parties agree as follows:
