Such terms and conditions <br />may include, but are not limited to, protection from injury <br />due to increased carriage losses; protection from a diminished <br />quantity or quality of water available to the company and/or <br />the shareholders; protection from the burden of increased <br />administrative and operational difficulty and expense; and <br />the requirement that the shareholder continue to pay his <br />annual assessments for maintenance costs. <br />The purposes subject to the above requirement are <br />as follows: <br /> <br />(i) The delivery of water to any person or <br />entity not a shareholder. <br />(ii) The delivery of water to any person or <br />entity, whether a shareholder or not, for use outside <br />the area served by the south Platte Ditch and the Sand <br />Hill Ditch (or South Platte Extension Ditch) as of the <br />effective date of these bylaws. <br />(iii) The delivery of water to any person or <br />entity, whether a shareholder or not, for any use other <br />than domestic, irrigation or stockwatering. <br />(iv) Any change of any water right represented <br />by company stock, including the use of such water right <br />in any plan for augmentation. <br /> <br />-15- <br />
